Merit System Protection BoardProviding fairness, equality and justice for all. Upon the legislative sunset of the Civil Service Board, the Merit System Protection Board (MSPB) was created by County Ordinance 2005-38 to provide a fair and equitable mechanism for the expeditious review of appeals and grievances of the classified employees of the county before a non-partisan deliberative body. Presently, the classified employees under the jurisdiction of the Board of County Commissioners, the Sheriff's Office and the Santa Rosa Island Authority are covered under the MSPB. Board members for the MSPB are composed of appointments by the Board of County Commissioners, The Board of County Commissioner's employees, the Sheriff, and the Sheriff's Office employees. The four appointed board members would select the fifth member to the Board. Upon the establishment of the MSPB, interim staff was appointed for three months until the Board was seated. Under the creation of the Ordinance, the MSPB has the power to select its staff. Serving as Interim Executive Director is Kay House; serving as Interim Attorney is V. Keith Wells. Both served in the same capacity under the Civil Service Board HEARINGS ---- APPEALS --- GRIEVANCES --- MEDIATION County Ordinance 2005-38 provides the means for a classified, permanent employee under the jurisdiction of the MSPB to appeal disciplinary actions, and may file an appeal or grievance for perceived violations of the Ordinance or the Rules. APPEALS - When a disciplinary action causes loss of salary by way of a suspension, a demotion, or a termination, a classified, permanent employee under the jurisdictionof the MSPB may file an appeal. The appeal sets the hearing process in motion. GRIEVANCES - In order to file a greivance, the employee must show that the employer has violated some section of the Ordinance or the Rules. MEDIATION - Mediation offers the employee and the employer the opportunity to mediate the dispute in a more informal setting without witnesses. Before mediation is conducted, both parties must agree to the mediation process. If an agreement is not reached during mediation, the employee may request a hearing. Reference Documents: |
